Trademarks serve to protect a specific identifying mark of goods or services.
In principle, all graphically representable identifications can be protected as trademarks, provided they serve to distinguish your own goods or services from those of the competition (e.g. the product name as a word mark or the company logo as a figurative mark).
In addition there are other types of mark, such as three-dimensional marks and sound marks.
In order for an identification to be registered as a trademark, it must be distinctive, i.e. it must not be directly descriptive of the goods or services in question, and it cannot be a term that must generally be kept freely available (“fair use” concept).
A trademark’s term of protection lasts for 10 years and can be extended as often as required.
